The Practice of surrogacy in India for Indian Residents or Overseas Citizen of India (OCI) has undergone considerable transformation over the last twenty years, establishing itself as a favored option for couples dealing with infertility. In this process, a woman, known as the surrogate mother, carries and gives birth to a child for another individual or couple, referred to as the intended parents. India has emerged as a prominent center for surrogacy, attributed to its cost-effectiveness, the presence of qualified medical professionals, and historically more permissive legal frameworks. However, the lack of regulation raised ethical and legal issues, leading to the introduction of legislative measures. The Surrogacy (Regulation) Act of 2021 was enacted to safeguard the rights of all parties involved. The couple must have been married for a minimum of five years, with the woman aged between 23 and 50 and the man between 26 and 55 years. Although International Intended Parents are no longer able to engage in surrogacy in India due to the stricter regulations, the practice remains a crucial option for many Indian families aspiring to become parents.
